Terms of sale
The terms you are agreeing to when you place an order or accept a quotation from Orindo Prima.
When a contract is formed
Placing an order is an offer to buy. A contract forms when we confirm the order by email, or when we confirm acceptance of a quotation. We may decline an order — for example where stock is no longer available or a price was listed in error — and will refund anything already paid.
Pricing
Prices are in Malaysian Ringgit and exclude SST, which is applied on the invoice at the rate applicable to the goods. Prices on the website are list prices; quoted pricing reflects the quantities on your quotation and supersedes list for that order.
A quotation is valid for 30 days from issue unless it states otherwise. After that we may re-issue at current prices.
Payment
- Online payment — by FPX, card or e-wallet through our payment provider. Goods are reserved on authorisation and released on settlement.
- Bank transfer — against a proforma invoice. Stock is held for five working days; goods ship once the transfer clears.
- Purchase order — for approved institutional accounts on agreed credit terms. We confirm the LPO reference before dispatch.
Where credit terms apply, invoices are payable within 30 days of the invoice date unless agreed otherwise in writing.
Delivery, risk and title
Delivery estimates are estimates, not guarantees, and made-to-order lead times depend on the manufacturer. We will tell you promptly if a date moves.
Risk passes to you on delivery. Title passes when we have received payment in full.
Specification and fitness
Competition equipment is supplied to the specification stated on the product page or the quotation. Where you are buying against a governing body's requirement, it is your responsibility to confirm which specification the competition requires — we will advise, and will tell you plainly where a cheaper option is adequate, but the final call is yours.
Manufacturers occasionally revise specifications. Where a revision is material we will contact you before dispatch.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. Subject to that, our liability for any order is limited to the value of that order, and we are not liable for loss of profit, loss of a fixture, or other indirect loss.
Governing law
These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction.
